Recently our office successfully settled a slip and fall on snow and ice case for our client for $90,000. Our client arrived to work and parked her car in the parking lot. Upon exiting her vehicle she proceeded to walk when she suddenly slipped and fell on ice in the parking lot.

She would unfortunately sustain a fractured wrist and was suspected to have developed complex regional pain syndrome (CRPS), a very serious injury.

We pursued for her both a workers’ compensation case as well as a third-party negligence case. We filed a claim for workers’ comp benefits for our client at the Department of Industrial Accidents.

After conciliation but before conference, we were able to settle via lump sum her workers’ comp case for $47,5000. This got some money in our client’s pocket since she had not worked since her accident. Plus, that case was settled with liability meaning the workers’ compensation insurance company would for the rest of our client’s life be required to pay for her medical treatment related to this work injury.

We followed that up with a third-party lawsuit against the owner of the parking lot. We alleged they failed to reasonably remove the ice from the parking lot which led to our client’s injuries. Shortly after the litigation began, that case settled for $90,000.

This case is an example of a case having both a workers’ compensation, as well as a third-party component. Thankfully we were able to get our client compensation for her injuries, which she rightfully deserved.
