What to do after a hit and run

Immediately after the accident try to get any information you can for the other vehicle. Be sure to call the police and tell the responding officer as much detail as you can about what happened in the accident.

Also be sure to request an ambulance if you are feeling any onset of pain. If you decline the ambulance, and the next day you are feeling pain, get checked out by a medical professional.

Make sure to report all of your injuries and the fact that they were caused by the accident when you see your doctor. That way your medical records will accurately reflect your injuries from the crash.

Be sure to also contact your car insurance company as quickly as possible. Report exactly what happened with as much detail as possible

What insurance is available?

If the other vehicle cannot be identified, your hit and run claim can be pursued as an uninsured motorist claim. This is a claim for insurance benefits with the insurance company that insures the vehicle you were in at the time of the accident.

Each motor vehicle in Massachusetts is by law requires to carry a minimum of $20,000 in uninsured motorist benefit coverage. If a settlement is not reached, you may not file a lawsuit against the insurance company. What you can do is demand arbitration. An arbitration is an informal out-of-court trial with an arbitrator who acts as a judge and makes a decision on your case that is binding, and with very limited exceptions, not appealable.
