If you’ve been injured due to negligence in an accident, you may be wondering how to file a personal injury claim. It is important to follow the proper procedures so that your claim is filed with the correct party, as well as with the correct insurance company.
If you were injured in a motor vehicle accident, you, or your attorney, would file a claim against the driver that caused the accident. That driver’s insurance company will then become involved. A claim will set-up, and an investigation will begin. If a settlement agreement is reached, the insurance company will pay that to the claimant.
For other cases, such as premises liability cases, the attorney for the victim will send the property owner a letter of representation. That letter will then be forwarded to the insurance company that insures the property. As with motor vehicle accident cases, if a settlement is reached with the insurance company for the personal injury case, then the insurance company will pay that out to the injury victim.
Keep in mind that even if you were partially at-fault for accident, then you may still pursue a claim. This is called comparative negligence. As long as you were not more than 50% at-fault, you will not be barred from receiving a settlement.
