How To Write A Demand Letter

Ok, so you have concluded your medical treatment following your personal injury accident and now it is time to negotiate your claim with the insurance company. In order to effectively begin settlement negotiations, you must first know how to write a demand letter.

Your demand letter should first state the facts of the accident. For example, if you were involved in a motor vehicle accident, you want to describe how the crash happened, and why the other party involved is at fault.

Your demand letter should then go on to list all of the medical treatment and medical expenses that you incurred as a result of the accident. Be sure to indicate your periods of disability and whether or not you sustained any permanent injuries.  In the event you missed any time from work, be sure to indicate that in your letter. Be sure to attach any and all photographs that you have regarding your accident, as well as proof of lost wages, and all of your medical bills and records, as well as any other documentation that lends support to your claim.

Your letter should conclude with a settlement demand. Make sure the actual demand amount is reasonable or the insurance adjuster will think you don’t know the real value of your case.

A few weeks later you will receive an offer of settlement from the insurance company, assuming of course that liability is in your favor.  Remember, be firm, professional and courteous when negotiating your claim with the adjuster.
